Article IV Section III: Emergency Clause

  • _Original text:

In the event of crises that involve the complete absence of any judges, as judged by the European Council, the European Commission may appoint interim judges over a period of fourteen (14) days._

    **Proposed text:

In the absence of any judges, as determined by the European Council, the European Commission may appoint temporary judges for a period of fourteen days.**

During which time nominations and elections should be held for their successors?

Hmm I'm not sure about this, should the Commission really have the power to appoint ECoJ, I think the chief justice should appoint one, perhaps an order of succession is needed as well for this?

  • That could work. How about this?

    **Proposed text:

In the absence of one or more judges, as determined by the European Council, the Chief Justice may appoint temporary judges for a period of fourteen days. In the event of the Chief Justice's absence, the remaining judges will elect from among themselves a temporary Chief Justice. After fourteen days, if an absent judge has not returned to their post, the post will be considered vacant and subject to a special election.**
