Declaration of Absence



  • [i]Willem Rillay approached the podium,

    [/i][size=2]Dear Councillors, our government is in shambles. The European Court of Justice has arguably once again failed the European people. One of the most vital cases to have ever surfaced in the court has gone unanswered after a month of statements from both sides. This stems from inactivity of two justices, Justice Hovland and Chief Justice Scalin, while the requirement of the presence of Justice Hovland is marginal to say the least; the court requires a chief justice who will actively and consistently participate in all cases before the court. I hereby propose ,using [/size]Article IV, Section III, Clause III of the Constitution as my legitimate reference,  this declaration of absence.

    [code]The European Council, RECOGNISING that the European Court of Justice's response to the Beech v. United Kingdom and United Kingdom v. Beech petitions has been unacceptably slow;

    ACKNOWLEDGING that this inaction has led to the Commission and ECoJ elections to be delayed indefinitely;And NOTING that Justice Kennet and Justice Isztvrarati , and that due to her nationality, Justice Dorr should not be expected to be actively involved in these cases;

    Thus:DECLARES that Justice Hovland and Chief Justice Scalin are ABSENT

    And REQUESTS that the remaining Justices of the European Court of Justice elected among them a temporary Chief Justice; who according to their own personal accord may appoint an additional Justice to fill the vacancy of Justice Hovland until such time of the completion of the currently suspended election for both the European Commission and European Court of Justice.
