EUROPEAN COMMON CULTURE AND EDUCATION ACT

PREAMBLE
Believing culture and education can bring the Peoples of Europe closer;
Acknowledging the historical ties between Member States strengthened by common values and heritage;
The Council hereby proposes this Act:
SECTION I. PRINCIPLES

The Union shall contribute to the development of quality education by fostering cooperation between Member States and, if necessary, by supporting and supplementing their action, while fully respecting the responsibility of Member States for the content of teaching and the organisation of education systems and their linguistic diversity. However, Member States shall retain their full sovereignty on such matters, as underlined in Article I, Section I, 8 of the Constitution of the European Union.

Union Action shall be aimed at:
a. developing the European dimension in education, particularly through the teaching and dissemination of the languages of the Member States and European symbols, institutions and history,
b. encouraging mobility of students and teachers, by promoting, among other things, the academic recognition of diplomas and periods of study,
promoting cooperation between educational establishments,
c. developing exchanges of information and experiences on issues common to the education systems of the Member States,
d. encouraging the development of youth exchanges and of exchanges of socio-educational instructors, and encouraging the participation of young people in democratic life in Europe,
e. encouraging the development of distance education. -
The Union and the Member States shall foster cooperation with third parties, such as private, national or international, organisations in the field of education.

The Union does not maintain the final authority on countries approving student visa status or comparable status that allows persons to study in the country so desired. The authority lies with the Member States and their national governments' immigration policies. Member States shall grant student visas to any candidate eligible for the program.

The legislation is intended to promote opportunity within the Member States to facilitate agreements that will allow periods of study in other nations for specific portions of time. Member States will compensate each other for every student that studies in a Member State of which they are not a citizen during the period in which they are studying. Member States shall have the right to offer students a tourist visa until they find a job, in order to benefit from their formation and possible future productivity.

Study opportunities provided by Member States do not guarantee a right to abode in Member States. Right to abode must be followed in accordance with national governments and immigration policies therein so long as the policy is fair and follows the outlined articles of the Universal Declaration of Human Rights. Proper documentation must be sought out through the Union or national government of choice and proof of continuing study must be provided as well.

Member States that comply with a quota of at least 10% of foreign students/institution shall receive economic incentives from the Union

The Union shall contribute to the flourishing of the culture of the Member States, while respecting their national and regional diversity and, at the same time, bringing the common cultural heritage to the fore.

Action by the Union shall be aimed at encouraging cooperation between Member States and, if necessary, supporting and supplementing their action in the following areas:
a. improvement of the knowledge and dissemination of the culture and history of the European peoples,
b. conservation and safeguarding of cultural heritage of common European significance,
non-commercial cultural exchanges,
c. artistic and literary creation, including in the audiovisual sector. -
The Union and the Member States shall foster cooperation with third parties, such as private, national or international, organisations in the field of culture.

The Union shall take cultural aspects into account in its action under other provisions of the Council Acts, in particular in order to respect and to promote the diversity of its cultures.
SECTION II. INSTITUTIONS: EICE

The "European Institute of Culture and Education", subordinated to the European Union, shall be the organism tasked with the coordination between the Member States that adhere it in terms of collaboration and exchange programs. The EICE shall only exerce its powers over Member States that adhere it.

The EICE Board of Trustees shall be composed of one appointed representative per Member State adhering to the institute.

The EICE shall be the reference for any implementation of European studies in national teachings programs.

The EICE shall have the power to advise Member States on the cultural events scheduled by their own government agencies. Final decision-making falls upon Member States’ organisms.

The EICE shall establish a network between public museums around Europe in order to promote the exchange of art and collections and whose objective will be to make foreign culture more accessible within the Union. Private institutions shall also be invited to participate.

The EICE shall be tasked with the enforcement of this Act, the European Heritage Site Act (2010), as well as any future legislation passed by the European Council concerning education and/or culture.
SECTION III. EDUCATIONAL PROGRAMS

Member States retain their sovereignty in terms of implementing the educational programs fostered by this Act.

The "European Basic Teachings Program" (aforementioned as the dissemination of the languages of the Member States and European symbols, institutions and history) shall be established as common educational content throughout the territories of Member States adhering to the EICE (limited by Member States' own system).

The EICE shall issue the "European Baccalauréat", an educational curriculum available at any public or private institution that requests its implementation, which will replace the final 2 years of Secondary education and will integrate the "European Advanced Curriculum", focused on the diversification of studies on a European level and equivalent to each Member States’ tests/diploma for admission to university.
a. The "European Baccalauréat" shall comprise three “general branches” of knowledge:
i. Sciences
ii. Economics and Social Sciences
iii. Humanities and Literature
b. Each branch shall be subject to a specialisation during the 2nd year and to Optional Subjects available throughout both years (a maximum of 4 Optional Subjects is permitted).
c. Each branch shall comprise a specific curriculum:
i. Sciences:
A. 1st Year:
I. Pure Mathematics II. Physics & Chemistry III. Biology IV. National language(s) V. National History & Geography VI. European Basic Teachings Program VII. Physical Education
B. 2nd year:
I. Pure Mathematics II. Physics & Chemistry III. Biology IV. National History & Geography V. European Basic Teachings Program VI. Physical Education VII. Philosophy VIII. Specialisations: Pure Mathematics OR Physics & Chemistry OR Biology
C. Optional Subjects (available during 1st and 2nd year):
I. Foreign Language II. Arts III. Regional Language IV. European Advanced Language (special mention given to the diploma) V. Computing Sciences
ii. Economic & Social Sciences:
A. 1st year:
I. Economics and Social Sciences II. Mathematics applied to Economics & Social Sciences III. Scientific General Culture IV. National language(s) V. National History & Geography VI. European Basic Teachings Program VII. Physical Education
B. 2nd year:
I. Economics and Social Sciences II. National History & Geography III. European Basic Teachings Program IV. Physical Education V. Philosophy VI. Specialisations: Mathematics applied to Economics & Social Sciences OR Detailed Economics OR Political Sciences
C. Optional Subjects (available during 1st and 2nd year):
I. Foreign Language II. Arts III. Regional Language IV. European Advanced Language (special mention given to the diploma)
iii. Humanities and Literature:
A. 1st year:

d. Final exams prior to diploma obtention shall be divided upon the two curricular years:

- Each Member State adhering to the EICE shall be able to make modificatons to the EB according to their own national reality (in domains regarding language, religion etc.).
NOTES
- s. II(6) subjects the enforcement of the European Heritage Site Act 2010 to the EICE, which is in conflict with s. III(1) of the Committee Reform Act 2013, which makes the European Arts Collaboration Board responsible for the European Heritage Site Programme.
