      Eastern Haane Intervention Motion

      Proposed by Internal Affairs Commissioner Jean-Claude Juncker (Spain) and Cllr. Hetty Tilki (Inimicus)


      We, the nations of the European Union,

      • HAVING WITNESSED the breakdown of legal order and governmental authority in Eastern Haane;
      • CONDEMNING the immense violence and breaches of any and all principles of human rights and dignity in the territory of Eastern Haane;
      • ACTING with good faith to protect the citizens of our individual nations, of other European countries, and above all, the people of Eastern Haane;

      Enact the following:

      1. The European Council hereby calls upon European member states to collectively, and with unanimous agreement of those nations taking part, form a Coalition to intervene by military and covert means in the territory of Eastern Haane with the final and resolute goal of bringing an end to the civilian and official casualties and destruction.
      2. Member states willing and able to join this Coalition mandated by the European Council must make their intention to do so known within 48 hours of the passage of this motion.
      3. Members of the Coalition intervening in Eastern Haane must inform and brief the European Council on their actions in the territory of Eastern Haane at least once every 96 Hours.
      4. Any member state intervening in Eastern Haane, or continuing to do so after the passage of this motion, is hereby condemned by the European Council and may face legal action in the European Court of Justice.
        a. Member states intervening in Eastern Haane outside of the Coalition, who then join said Coalition within 48 hours of the passage of this motion, may be exempt from measures under this section.
        b. Any member-states which have engage in open combat with any native elements or groups within Eastern Haane shall not be allowed to take part in further military actions in the nation even as part of the coalition. These member-states shall be allowed to continue humanitarian and medical actions under supervision from the coalition commander. This section shall be appealable to the coalition commander.
      5. Member states of the Coalition may accept refugees from Eastern Haane into their country through any transportative means that does not involve the use of military weaponary.
      6. This coalition of willing members shall be lead by a commissioned flag officer who shall be appointed by the Premier Commissioner on the consent of participating members. This flag officer shall be from a nation with no previous attachment to operations within Eastern Haane.
      7. The coalition shall only have legal merit until the 31st of December, 2020. The European Council in the weeks proceeding this expiration shall consider an additional three month extension.

      Councillors, Cllr. Tilki and I have decided to submit this intervention motion to bring peace into Eastern Haane as soon as possible. I hope the discussion is opened as soon as possible and that if not every single of them, most of the nations here support the motion. Thank you very much.

          I support this motion too, and moreover, I hope that the Council and the Commission can cooperate together in the direction of the intervention in Eastern Haane. We need to bring back peace, to tell those people we are standing with them, and this is the first step for it.

              Dear colleagues,

              As I'm sincerely supporting this proposal in order to protect the people of Eastern Haane, I don't feel confortable with the idea of a military coalition acting in a member state. You all know that my country, Nofoaga, is a peacekeeper and true and prosper solutions can only be reached trough talking with each other and come to clear and stable agreements.

              As I've mentioned before, I do support this proposal but I would like to see also space for talking and discussion with the today's authorities of Eastern Haane to ensure the best for the Eastern Haane people. No one is helped with a unilateral invasion, even if it seems justified.

                Thank you for your feedback Cllr. Muzhare, which I have listened with interest and made some notes. I think that the Commission has proven we wanted a peaceful solution using diplomacy, we even reached a treaty but days later, everything turned dark and impossible to manage. I'm sad we need to do a military intervention, i'm sad about risking more lives in a conflict we need to solve.

                But I trust that we will be able to solve this conflict, deploy the European Relief Force for peacekeeping and mediate with all the factions to end with this bloodbath and conflict in Eastern Haane. But we need to remain united, and I know that Nofoaga will cooperate with the European Union as many other nations. Thank you.

                  Colleagues, I am very much in support of peaceful means of solving this crisis. But, I am now confused whether I will support the use of military cooperation or diplomacy. I have got news that guerilla forces open fired on our troops in the area. Our forces tried to retaliate but Gen. Renwalt spoke to stop the firing and asked the forces to surrender peacefully to be properly given care as refugees. My country has also tasked me to ask help on caring for this refugees.

                  I do not know if there is still hope for us to use peaceful means to solve this conflict. But for now, I'd like to listen for more of your suggestions in such matter.

                      Councillor van Allen, I think that if we want a responsible European Union, where we defend the interest of the nation affected by this conflict and not of any foreign nation, we need this cooperation. This is not a peaceful solution, it's a military intervention. Your country is at the moment taking the Eastern Haanean capital city and raising European flags everywhere while the EU hasn't given you any support.

                      We need to care of refugees too, becayuse there will be many of them, and then we will need to deploy the European Relief Force to accomplish the peacekeeping functions they will be given. But if we don't get cooperation, this won't be possible. Coordination is needed, cooperation is to. If someone here wants to proof he or she believes in Europe and its unity, and wants to solve this conflict not with his country army but the European cooperation, unity, solidarity and coordination, it's the moment for you to raise your voice. I want to do it like that, and I think we need to get into a common agreement. We can't allow more Haaneans to die, we need to answer united and coordinated. Let's proof what our values are right now.

                        I agree with Commissioner Juncker, we The Kingdom of Montenbourg accept this motion. We want to make it clear that we are a neutral nation, our efforts will only be in behalf of the European Relief Force for peacekeeping, if possible all our troops would be present in here. We do not want to violate our neutrality.

                        Of course with the annuace of this council we can proceed.

                              Thank you Mr. Speaker. Estimable members of the European Council, good morning.

                              I am here to present the acts that have been committed by the Haaneans in this crisis. Certainly, I do not think that diplomacy is still a solution to be considered in solving this problem.

                              I have here video recordings showing the Haaneans using a poisonous substances against our forces. We have identified the chemical as a form of opium that they burnt which caused more than 200 of our personnel to lose consciousness or even die. Our Medical Support Corps have tried to save some of our men but they failed. These guerilla rebels were identified as pro-Socialist armed groups that captured 2 Challenger 2 tanks and 1 Slingshot Howitzer from our team. They also blew up the runway at the former Kiel Airport and placed nails on the path of our Artillery regiments to prevent them from getting any further.

                              I request this estimable body to consider my suggestion to stop these forces due to their use of bio/chemical weapons against us. In response to their attack, we have used our Armed/Attack Helicopters against them loaded with rocket pods to try and stop them from doing any further damage.

                                Firstly I would like to present the following amendments:


                                AMENDMENT 1:

                                1.                                 It goes without saying I am very much distressed by the entire situation revolving Eastern Haane, its capacity to turn bad into worse should not go underestimate it should seem.

                                There is a European solution to this crisis, however, it seems some nations have elected to apply their own definition of a European solution to this crisis. I will not beat around the bush, and share my government and people's sentiment towards the nearly vigilante justice surrounding the Reitzmag 'excursion' into Eastern Haane. I pity the men and women dying over there due to the shortsightedness of their leaders.

                                "I do not think that diplomacy is still a solution to be considered in solving this problem." coming from the man whose nation on their own, from no one's invitation or support thrust themselves into an evolving and turbulent crisis. There was a diplomatic solution sir, and there still is. Unfortunately I doubt Reitzmag can be part of a diplomatic solution anymore, at least one lead by Europe.

                                Eastern Haane has a culture, history, and societal structure unlike anywhere else in Europe. I do not believe we can impose European Order without the participation of Eastern Haaneans in said process. That was in the process of being deprived from them when the Kingdom of Reitzmag attempted to instate its own order. It went far away from the notion of humanitarian aid by attempting to capture an entire city, airport etc. without considering the response from local groups.

                                I condemn the use of chemical agents on Reitzmic troops, and the claim if true should be investigated and prosecuted to the fullest extent of European law. Much like how Reitzmic officers should be investigated and prosecuted for violating the principals of the UDoHR with their blatant disregard for life, and disproportional response to attacks upon them. Apparently when one throws a stone, a tank shoots back according to Reitzmag combat doctrine.

                                I am not condoning the actions of any group within Eastern Haane, I am acknowledging the reality of attempting to impose any form of peace or order without first working out what that should mean. If this coalition is to be a success we need to include a variety of Eastern Haane individuals in the process, and they should be leading it themselves. Their a people whose history is filled with tyrannical actions, we must not present Europe as another avenue to tyranny but instead an avenue to support and defend democracy.

                                I personally hope the Kingdom of Reitzmag looks upon the public nightmare awaiting it if more men and women throw their lives away unnecessiaricily and looks toward actually fulfilling the goals it set to. If the current violence continues, the Archrepublic will not hesitant to forcibly separate the parties as necessary to prevent more loss of life through any means necessary.

                                The Four Assembled Powers of Vayinaod, Fremet, Inimicus, and Spain will begin their no-fly zone this Saturday, I would like to forward to all councilors a reminder of this if they are planning on executing any missions in Eastern Haane to include this in their planning. This no-fly zone will be strictly enforced. I will be happy to answer questions regarding this, as well as forward any I might not have a proper answer to at this time.

                                  First, I would like to announce that the President of the Commonwealth will continue with his plan to construct the refugee camp manned by 450 troops. The state of that operation has not been told to me yet as i was not in today's cabinet meeting, but i have discussed with the President and he will gladly co-operate with the Four Assembled Powers No-Fly Zone and be sure to land at Spain or Inimicus for the port of entry before reaching Eastern Haane. The goal and procedures for the camp have already been announced but those troops that will be sent have orders not to advance; instead, they are only to defend the camp and avoid open combat as much as possible. I have been told by the Leagioan Minister of Defense that no heavy weaponry is being moved. The most that i would say that is the heaviest weapon is an RPG, but only because we have heard that the Reitzmag Army lost 2 tanks in open combat and are being used against them. After the camp is built, the only things that the tranpsort aircraft will be carrying as they move back and forward will be suppilies, medicine, and vechile transportation for the extraction of refugee's wanting to get out of Eastern Haane. This vechile will not be used for any military advancement but instead for the purpose of getting the rufugee's safely out of Eastern Haane. I will be sure to provide as much information about as i can until the coalition is finally made through.

                                  Now, focusing on the amendments that Councilor Falk presented, i will not admit that i would rather that they were presented after the passage of the motion itself but i will not argue the reason for these amendments.

                                  But I must ask for some clarification over the last sentence on section 4 clause b, Councilor Falk. Because I am trying to make I understand it to form an opinion about. Could you possibly explain to the Council what you mean on "this section shall be appealable to the coalition commander" ? Does that translate to that the commander can ignore the top bits of the same clause or have a different meaning that I am failing to grasp?

                                  Another question that i have is when Leagio does commit to the refugee camp, what if open combat happens where it was not started by the member-state but by the native elements or groups within Eastern Haane? Does the top sentence of claus b apply to open combat in general whether the member-state intended to get into it or not? Even if it was for humanitarian purposes? Like say for example, and god I hope that it does not happen, but what if the refugee camp gets attack leaving a Leagioan troop without any choice but to open fire as manner to protect the refugees?

                                    To answer your questions Cllr.

                                    "This section shall be appealable to the coalition commander." is to imply that Section 4B may be appealed to the coalition commander who can make the determination as to whether it should apply based on contextual situations. There is an infinite number of potential situations, and I felt making sure that it can be resolved quickly could be possible based on the decision of the coalition commander.

                                    Moving into your second question as it somewhat connects with the first. This section is to state that member-states that have engaged in combat should be removed as part of a continued peacekeeping operation prior to the instatement of a European mission. It will not be beneficial to have states which were active in military operations against local elements not be part of the group attempting to work with some of those elements and potentially police them.

                                    If Leagioans were to defend themselves, unless they appealed to the coalition commander, they would be limited to simply their humanitarian and medical mission and not other military combat situations. If they wished they could appeal this to the coalition commander, and this would only apply to member-states engaged prior to the passage of this act.

                                    The point is that no state prior in Eastern Haane had a legal backing to be there, and has not potentially severely crippled prospects for a European introduced peace process, including rebuilding. We must simplify the equation, and remove potentially incendiary parts to said equation.

                                    I understand that these sections may not be clear enough in those regards, and welcome others to submit amendments under a similar vein.

                                      I have no objections to Cllr Falk's Amendment 1, I think this makes sense and I will wholeheartedly support it. I do take some issue with Amendment 2 - of course, I am well aware this is very much meant to point towards the forces of Reitzmag currently active in Eastern Haane. I think it would be unwise for the coalition to pre-emptively exclude any members from anywhere. I still have hope Reitzmag may come about and work for peace in the region.

                                        Your honor Coun. Tilki, we will be waiting for a decision from Prime Minister Bridges and I can see that there is a high chance he will let our armed forces to join the coalition as we have already done a lot of work on the area. I though condemn the establishment of a no-fly zone between countries that have not even begun operations in the area. We cannot proceed with more of our mission if such is permitted.

                                          Colleagues, I am very saddened about Amendment II of Coun. Falk. The role of my country's armed forces will be very important in the coalition. As they have been the ones who have engaged in a full combat with guerilla forces, they have the knowledge on how these forces could treat the coalition that we are planning to form. I thank Coun. Tilki for being against the second amendment as I do also believe that it would be very unwise to exclude us from the coalition. So I ask my other dear colleagues to vote against Amendment II.

                                          Finally, I'd like to ask for a short debate extension so we can plan properly how we will face this situation.

The people of Northern Haane are suffering like no other people has in this Union of late, and the European Council cannot be seen as bickering over who is allowed to take part in a relief effort and who is not. I trust you will make your ruling on this in good faith, as you always do, but I suggest we move to a vote on the amendments and the motion as soon as possible"
